1. Acceptance of these terms

These Terms of Use govern your access to and use of the KuwaitMalls website at kuwaitmalls.com and any related pages or services (together, the Service). By using the Service you agree to these terms. If you do not agree to them, please do not use the Service.

If you use the Service on behalf of a company or other organisation, you confirm that you are authorised to accept these terms on its behalf.

2. Definitions

Service

The KuwaitMalls website and any features offered through it.

Content

All information published on the Service, including listings, categories, text, layout, design and images.

Listing

A record describing a mall, brand, branch, restaurant, café or entertainment venue.

Claim

A request by a business to take responsibility for maintaining its own listing.

Submission

Anything you send us — a correction report, a claim request, an enquiry or your email address.

3. The service

KuwaitMalls is an informational directory. It helps people find shops, restaurants, cafés, entertainment venues and offers in Kuwait, and tells them where those places are.

The Service does not sell goods or services, does not process payments, does not take bookings or reservations, does not arrange delivery and does not report live product availability or pricing. Any transaction you enter into is strictly between you and the business concerned.

Some parts of the Service may be described as coming soon, in preview, or in beta. Those parts may change or be withdrawn without notice.

4. Accuracy of information

We take accuracy seriously. Listings are compiled from official and public sources, from the businesses themselves, and from corrections reported by users, and we record where each detail came from and when it was observed.

Even so, retail information changes constantly. Shops relocate and close, menus and concepts change, and opening hours differ during Ramadan, public holidays and special events. The Content is provided for general information only and without any warranty that it is accurate, complete or current.

Before you travel, spend money or otherwise rely on a detail — particularly opening hours, a location, a phone number or a promotion — please confirm it directly with the business.

5. Listings and business claims

Appearing on KuwaitMalls does not imply any partnership, sponsorship, endorsement or affiliation between us and the business listed, in either direction. We are independent of the malls, brands and operators we list.

A business may ask to claim its listing. We may ask for reasonable evidence that you are authorised to act for that business, and we may accept, refuse or withdraw a claim at our discretion. A claimed listing must be kept accurate and must not be used to publish misleading information, unrelated advertising, or content that infringes anyone's rights.

We may edit, suspend or remove any listing — including a claimed one — where we believe it is inaccurate, misleading, unlawful or in breach of these terms.

6. Your submissions

When you send us a correction, a claim, an enquiry or any other material, you confirm that you are entitled to send it and that it does not infringe anyone else's rights. You grant us a non-exclusive, royalty-free licence to use that material for the purpose of operating and improving the Service, including publishing corrected details in a listing.

We review submissions before acting on them, and we are not obliged to publish, keep or act on any submission.

7. Intellectual property

The Service, its design, its structure, its original text and its compiled database are owned by KuwaitMalls and protected by applicable intellectual-property law.

Brand names, trade names, logos and trade marks belonging to malls, retailers, restaurants and other businesses remain the property of their respective owners. They are used on the Service for identification and reference only, and their appearance does not imply any association with or endorsement by those owners.

If you believe material on the Service infringes your rights, contact us at hello@kuwaitmalls.com with details of the material and your rights in it, and we will review it promptly.

8. Acceptable use

You may use the Service for your own personal, non-commercial research, and for legitimate business research about the Kuwait market. You may not:

• copy, scrape, harvest or systematically extract the Content or any substantial part of the database, by any automated or manual means, or build a competing directory from it;
• republish, sell, licence or redistribute the Content except for brief quotation with a clear credit and link;
• submit information you know to be false, or impersonate a business or another person;
• interfere with the Service, attempt to gain unauthorised access to it or to any related system, or place an unreasonable load on it;
• use the Service to send unsolicited marketing to the businesses listed, or for any unlawful purpose.

We may restrict or withdraw access where these rules are broken.

9. Third-party sites and businesses

The Service links to websites and social accounts operated by other people. We do not control them, we are not responsible for their content, products, services or privacy practices, and a link is not an endorsement. Your dealings with any business you find through the Service — including any purchase, booking, complaint or dispute — are solely between you and that business.

10. Availability of the service

We aim to keep the Service available and working, but we do not guarantee uninterrupted or error-free access. We may suspend, withdraw, restrict or change all or part of the Service, or any Content on it, at any time and without notice.

11. Limitation of liability

To the fullest extent permitted by applicable law, the Service and its Content are provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranty of accuracy, fitness for a particular purpose or non-infringement.

To the fullest extent permitted by applicable law, KuwaitMalls will not be liable for any indirect or consequential loss, or for any loss of profit, revenue, time, data or goodwill, arising out of or in connection with your use of, or inability to use, the Service, or your reliance on any Content — including where a listing turns out to be inaccurate or out of date.

Nothing in these terms limits any liability that cannot lawfully be limited.

12. Privacy

Our Privacy Policy explains what personal information we collect, why we collect it and what we do with it. It forms part of these terms.

13. Governing law and jurisdiction

These terms and any dispute arising out of or in connection with them or the Service are governed by the laws of the State of Kuwait. The courts of the State of Kuwait have exclusive jurisdiction, save that we may bring proceedings to protect our intellectual property in any competent jurisdiction.

14. Changes to these terms

We may update these terms from time to time. The version published on this page is the version in force, and the date at the top shows when it last changed. Material changes will be highlighted on the Service. Continuing to use the Service after a change means you accept the updated terms.
